Copyright - 101
There are many misconceptions and suppositions in the copyright clearance industry. We’re here to demystify fact from fiction!
Just because it’s online doesn’t mean it’s copyright-free!!
The content you find on YouTube, for example, must receive copyright clearance.
Yes, but the creator has passed away.
You still need authorization from his/her estate or beneficiaries.
But I’m only using three seconds of a song or archive.
Yes, three seconds is short, but you still need copyright clearance!
The prescribed limitation period differs from one country to the next.
In Canada, as of January 1st, 2023, a musical composition or piece of literature is now protected for 70 years after the passing of its last creator. This change to the Canadian Copyright Act does not affect works that were already in the public domain in 2022.
Copyright clearance can be a lengthy process.
If possible, plan ahead! Contact laNégo and let us advise you on all your specific needs.
All old works of art are public domain.
Not necessarily! Some belong to museums, like the Mona Lisa, which is owned by the Louvre.
Interview-related support
“Interview-related support” does not apply to archives and music; it’s a notion resulting from the UDA collective agreement only. As such, you must obtain permission from the rightsholders.
Promo
The act of promoting is not an exclusion outlined in the Copyright Law of Canada; while some rightsholders might graciously accept such usage of material, you still need copyright clearance.
